Terms of Use

1. Acceptance of the Terms

By accessing or using Photo Future, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, do not use the service.

2. Who May Use the Service

Photo Future is intended only for individuals who are at least 18 years old and legally able to enter into a binding agreement.

The service is provided for personal, consumer use unless we expressly agree otherwise.

3. About the Service

Photo Future allows you to upload a photo and receive an AI-generated image showing a more mature or older-looking version of you.

The service is offered as a future-self visualization service for adults 18+. Results are generated by AI and may be stylized, imperfect, inaccurate, or unexpected. They are not factual predictions of real future appearance.

4. Accounts

Some features may require an account. When accounts are enabled, you are responsible for maintaining the confidentiality of your login credentials and for activity occurring under your account.

You must provide accurate information and keep it reasonably up to date.

5. Your Uploads and Responsibilities

You may only upload your own adult self-photo. You may not upload a child, any person under 18, or another person's likeness for use in the public Photo Future flow.

You retain ownership of your uploaded content, but you grant us a limited, non-exclusive right to host, process, transmit, and use that content only as needed to operate the service and provide the requested output to you.

We do not use uploaded photos or generated outputs submitted through the service to train or fine-tune our AI models.

You are solely responsible for the legality of your uploaded content and for any consequences of submitting content that violates privacy rights, publicity rights, intellectual property rights, or applicable law. We may refuse, remove, or restrict content that we reasonably believe violates these Terms or the law.

6. Prohibited Use

• Upload content you do not have the right or authority to use.
• Upload any photo of a child, minor, or person under 18 years old.
• Upload any photo of a celebrity, public figure, politician, or other person whose likeness you are not authorized to use.
• Upload nude, sexually explicit, pornographic, or fetish content.
• Upload unlawful, abusive, infringing, deceptive, or harmful content.
• Upload sensitive content or personal data of others without proper permission.
• Use the service for face swaps, identity verification, facial recognition, KYC, ID, passport, surveillance, deceptive impersonation, deepfake use, or celebrity/public-figure mimicry.
• Use the service or its outputs for harassment, revenge, defamation, blackmail, or other abusive targeting of a person.
• Interfere with the service, bypass limits, scrape content, or attempt unauthorized access.
• Reverse engineer, decompile, or attempt to extract source code or underlying models from the service.
• Use bots, scripts, automation, or bulk activity to abuse the service or create unfair load.
• Use the service or its outputs to build a competing product or dataset without authorization.

7. AI Outputs

AI-generated outputs are provided for personal use subject to these Terms. Because outputs are generated algorithmically, we do not guarantee accuracy, realism, uniqueness, availability, or fitness for any particular purpose.

You are responsible for how you use any generated output. You must not use outputs in a way that is unlawful, deceptive, defamatory, infringing, or harmful to others.

Outputs may be stylized, imperfect, incomplete, inconsistent, or unexpected. They may resemble other generated or publicly available content. They are not suitable for identity verification, legal evidence, professional advice, or factual predictions about a person's future appearance.

8. Subscription, Billing, and Auto-Renewal

• Paid access may be offered on a recurring subscription basis.
• Subscriptions renew automatically unless canceled before the next billing date.
• Pricing, billing interval, and any promotional offer are shown at checkout.
• Payment processing, billing, taxes, and certain refunds are handled by Polar as merchant of record.
• If a payment fails, access may be suspended, limited, or canceled until payment is resolved.

You authorize the applicable charges for your selected plan, including recurring charges until cancellation where the plan is a subscription.

9. Free Trials and Promotions

We may offer promotional pricing, discounts, or free trials from time to time. Unless stated otherwise at checkout, promotional terms apply only for the disclosed period and standard pricing will apply afterward.

If a free trial is offered, you should cancel before the end of the trial to avoid charges for the next billing period.

10. Cancellation and Refunds

You may cancel a subscription before the next renewal date to avoid future charges. Cancellation stops future renewals but does not retroactively reverse charges already incurred unless stated otherwise by us, required by law, or provided through an applicable refund policy.

Refund eligibility, if any, is governed by our published refund rules and applicable law. Because Polar acts as merchant of record, Polar may also issue refunds in certain situations under its own policies, payment rules, or discretion, including chargeback-prevention decisions.

11. Intellectual Property

The Photo Future service, including its design, branding, software, text, graphics, and underlying technology, is owned by us or our licensors and is protected by applicable intellectual property laws.

Except as expressly allowed in these Terms, you may not copy, modify, distribute, reverse engineer, resell, or exploit the service or its components without prior written permission.

12. Privacy

Our Privacy Policy explains how we collect, use, and protect personal data. By using the service, you acknowledge that your information may be processed as described in that policy.

13. Suspension and Termination

We may suspend, restrict, or terminate access to the service if we believe you violated these Terms, created risk for us or others, engaged in abuse or fraud, or where suspension is otherwise reasonably necessary.

We may also discontinue or modify parts of the service at any time.

14. Service Changes and Interruptions

We may change, suspend, limit, or discontinue any part of the service at any time, with or without notice, including features, pricing presentation, generation limits, account functionality, or access methods.

We do not guarantee that the service will always be available, uninterrupted, error-free, or compatible with every device, browser, or payment method. Maintenance, outages, bugs, third-party failures, and technical interruptions may occur.

15. Disclaimers

The service is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We disclaim warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

16. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business opportunities arising out of or related to your use of the service.

To the maximum extent permitted by law, our total liability for claims arising out of or relating to the service will not exceed the amount you paid us or through our merchant of record for the service during the 12 months before the event giving rise to the claim.

17. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Yerlan Kussainov and Photo Future from claims, losses, liabilities, damages, and costs arising out of your content, your misuse of the service, or your violation of these Terms or applicable law.

18. Governing Law

These Terms are governed by the laws of Kazakhstan, without regard to conflict of laws principles, except where mandatory consumer protection laws of your place of residence apply and cannot be excluded.

19. Miscellaneous

These Terms constitute the entire agreement between you and us regarding the service and supersede prior understandings related to the same subject matter.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of that provision.

We may assign or transfer our rights and obligations under these Terms in connection with a merger, acquisition, restructuring, or sale of assets. You may not assign your rights or obligations without our prior written consent.

We are not liable for failure or delay caused by circumstances beyond our reasonable control, including technical failures, infrastructure outages, acts of government, labor disputes, or force majeure events.

20. Changes to the Terms

We may update these Terms from time to time. If we make material changes, we will post the updated version and revise the last updated date. Continued use of the service after the updated Terms become effective means you accept the revised Terms, to the extent permitted by law.
